State Attorney Rebuffs Shepard Killer's Plea

Laramie, Wy – An attorney for the state says that a man convicted of murdering Matthew Shepard five years ago should NOT be given a chance to argue for a lighter sentence.
Russell Henderson filed a petition last month asking Judge
Jeffrey Donnell to find that he was denied effective
assistance of counsel after his guilty plea to felony murder and
kidnapping.
Henderson received two consecutive life terms without parole.
His attorney, Tim Newcomb, claimed the state's appellate lawyers
failed to consult with Henderson regarding any of his rights as provided by law following a guilty plea.
In its reply, the state said the judge should dismiss the petition because Henderson failed to offer a claim of error in the conviction process.
